Order Granting Motions for Summary Judgment of Invalidity and Non-Infringement

Auction Management Solutions, Inc. v. Manheim Auctions Inc., et al., 1:05-cv-00639 (N.D. Ga. March 24, 2009) (Story, J.)

Ruling on several motions for summary judgment, the Court first held that the claims of the patent-in-suit, which related to a software system for facilitating auctions, were invalid based on the public use and on-sale bars. The Court also found, in the alternative, that the claims were invalid because the specification failed to enable the full scope of the claims and failed to satisfy the written description requirement. Finally, the Court granted defendant’s motion that its accused auction system did not infringe the asserted claims, as previously construed by the Court, as a matter of law.
